(hereinafter referred to as “La Vasconia”) is one of the most reputable and long-standing companies in Mexico, made up of several kitchenware companies that offer high quality products, always seeking to generate confidence in its customers and suppliers. For this reason we inform you of this Privacy Notice in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulations, to inform you what personal data we can obtain, its purposes, as well as the terms in which we will be using them, seeking at all times to ensure their confidentiality and protection according to the physical, technical and administrative security measures that we have provided for this purpose.

RESPONSIBLE FOR PERSONAL DATA.

In order to carry out the purposes described in this privacy notice, we will classify personal data into the following categories:

  • Identification data:
    • Individual: Full name, official identification, CURP, RFC, proof of address, signature, date of birth and gender.
    • Legal Representative: Full name, official identification, CURP, RFC, Power of Attorney, proof of address and autographic signature (documents in copy and originals for comparison).
  • Contact information: e-mail, social networks, telephone, cell phone and proof of personal and fiscal address.
  • Fiscal Data:
    • Individuals: RFC, tax receipt and partial and annual returns for PFAE.
    • Legal Representative: Compliance with Tax Obligations and RFC card.

Financial Data: Copies of bank transfers, deposit slips and/or bank accounts, account statements, credit bureau, checks, income, expenses, real estate and personal property, financial statements and tax returns.

  • Work Data: Work address, e-mail, office telephone numbers, position held.
  • Commercial Reference Data: Request for references (in case of credit application or if required)
  • Other Data (social networks): When you follow us through social networks, the data obtained through this means are under the property and privacy policies of each of them, which were authorized by you at the time of registration so that “La Vasconia” has no rights or responsibility over the personal data of those who follow us or register on our social networks.

The above: will be obtained through the following forms, which are detailed below:
Personally: When you come directly to us and/or when we come to you.
Direct: When you provide us with your personal data via telephone, email, web page or any other digital means.
Indirect: When the transfer is to any of our subsidiaries, controlling or related parties that belong to Vasconia Brands, S.A. de C.V. or from any other commercially available source of information or that are permitted by law.
Sensitive data collected: According to the environment in which the different data are processed and the level of risk that their processing generates for the data subject, the following may be considered as sensitive data Patrimonial, Tax and/or Financial Data, that for no reason whatsoever “La Vasconia” may unilaterally dispose of such data without the prior express authorization of the owner.

SECONDARY PURPOSES

“La Vasconia” informs you that the data may be used for the following secondary purposes:

  • Statistical and commercial analysis to identify needs and classify customers.

  • Share with national or international third parties other than Vasconia Brands, S.A. de C.V., for auditing or commercial purposes, informing the holder that the information will only be transferred to third parties as long as they are obliged to safeguard the personal data and acquire the same obligations as Vasconia Brands, S.A. de C.V., informing the holder that at all times he/she will have the rights of Access, Rectification, Cancellation and Opposition.

The refusal to use your personal data for these purposes shall not be a reason for us to deny you the services and products you request or contract with us.

DATA TRANSFERS

Personal data that has been requested may be transferred or shared with the following persons, companies, organizations or authorities other than us for the following purposes.

The law provides for the transfer of data without the owner’s authorization. In case it is provided for in a Law or treaty to which Mexico is a party, it will be intended to comply with the obligations and responsibilities acquired at the time of contracting for prevention as indicated in Art. 10 and 37 of the LFPDPPP and its Regulations. The Company is subject to the provisions applicable to articles 18, 19, 20, 21 and 22 of the FEDERAL LAW FOR THE PREVENTION AND IDENTIFICATION OF TRANSACTIONS WITH RESOURCES OF ILLICIT PROPERTY, provided that the collection of personal data falls under the assumption of articles 17 and 18 of the same law.

Article 37.- National or international transfers of data may be carried out without the consent of the data owner in the following cases:

  • When the transfer is necessary or legally required for the safeguarding of a public interest, or for the procurement or administration of justice;
  • When the transfer is necessary for the recognition, exercise or defense of a right in a judicial proceeding, and
  • When the transfer is necessary for the maintenance or fulfillment of a legal relationship between the controller and the holder.

The recipients of the personal data entrusted and/or third parties, assume the same responsibilities of the Controller of the personal data in accordance with the terms defined in this privacy notice and must refrain from transferring the personal data unless it derives from a subcontracting authorized by the controller as indicated in art. 50, section 1. 6 of the LFPDPPP regulation. In the case of collection, transfer or processing of data with Legal Entities or Natural Persons that are members of the European Union, the data will be processed in accordance with the GENERAL DATA PROTECTION REGULATION of the European Union, with the supplementary application of the LFDPPPPP.

If you do not express your refusal to the transfer of your data, it will be understood that you have given your consent.

LIMIT THE USE OR DISCLOSURE OF YOUR INFORMATION.

In order for you to limit the use and disclosure of your personal information, we offer you the following means:

  • Your registration in the Public Registry to Avoid Advertising, which is in charge of the Federal Consumer Protection Agency, so that your personal data will not be used to receive advertising or promotions of goods or services companies.
